Dear Sirs:
We write on behalf of Blockware LLC (“Blockware”) because it has come to our attention that e-TekDepot is offering for sale and selling a multi-device charging station that is identical to the multi-charging station sold by Blockware and is unfairly trading of Blockware’s trade dress rights and the goodwill associated therewith. (See Exhibits A and B). Please be advised that e-TekDepot’s activities are in violation of Blockware’s trade dress and other intellectual property rights, and constitute unauthorized trading off of Blockware’s valuable assets and goodwill.
Blockware owns and operates a website called “Great Useful Stuff” and also sells goods on Amazon.com through a storefront with the same name. One of Blockware’s flagship items is a Multi-Device Charging Station and Dock, the trade dress for which Blockware has registered with the United States Patent and Trademark Office as Registration Number 4,733,389 (the “Blockware Trade Dress”). A copy of Blockware’s trade dress registration is attached as Exhibit C for reference. As a result of Blockware’s significant investments in product development and promotion, the Blockware Trade Dress has become widely recognized among consumers, and consumers have come to readily identify the distinctive shape and design of the Blockware Trade Dress with Blockware. The Blockware Trade Dress is an asset of great value that Blockware actively protects.
In order to maintain the value of the Blockware Trade Dress, Blockware must protect the Blockware Trade Dress from unauthorized uses that infringe its rights and that are likely to cause consumer confusion or otherwise dilute the distinctive nature of the Blockware Trade Dress. As further set forth below, e-TekDepot’s business activities are in clear violation of Blockware’s rights.
